Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Flowboard (“the App”), a monday.com application provided by Flowboard (“we”, “us”, or “our”). By installing, accessing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
Section titled “1. Acceptance of Terms”By accessing or using Flowboard through the monday.com Marketplace, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
2. Description of Service
Section titled “2. Description of Service”Flowboard is a collaborative whiteboard application designed to integrate with the monday.com platform. The App enables users to:
- Create and manage visual whiteboard canvases
- Collaborate in real-time with team members
- Add various content types including text, shapes, embeds, and monday.com items
- Access monday.com data through the integrated sidebar
3. License Grant
Section titled “3. License Grant”Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the App solely for your internal business purposes in connection with your authorized use of monday.com.
4. Use Restrictions
Section titled “4. Use Restrictions”You agree not to:
- Use the App in violation of any applicable federal, state, local, or international law or regulation
- Interfere with or disrupt the operation of the App or the servers or networks connected to it
- Attempt to gain unauthorized access to any portion of the App or any other systems or networks
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Copy, modify, distribute, sell, or lease any part of the App
- Use the App to transmit any unsolicited advertising, spam, or other unauthorized communications
- Use the App to collect or harvest any personally identifiable information from other users
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the App to create a competing product or service
5. Account and Access
Section titled “5. Account and Access”Access to the App is provided through the monday.com platform. You are responsible for:
- Maintaining the confidentiality of your monday.com account credentials
- All activities that occur under your account
- Ensuring that your use of the App complies with monday.com’s terms of service
6. Data and Privacy
Section titled “6. Data and Privacy”6.1 Data Storage
Section titled “6.1 Data Storage”Board data and content created within Flowboard is stored securely. We do not sell or share your content data with third parties except as necessary to provide the service.
6.2 monday.com Data
Section titled “6.2 monday.com Data”The App accesses monday.com data (such as items, users, teams, and documents) only as authorized by you and in accordance with monday.com’s API terms. We only access the data necessary to provide the App’s functionality.
6.3 Privacy Policy
Section titled “6.3 Privacy Policy”Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
7. Subscription and Billing
Section titled “7. Subscription and Billing”7.1 Payment Processing
Section titled “7.1 Payment Processing”All payment processing for the App is handled exclusively through the monday.com Marketplace in accordance with monday.com’s billing terms and conditions.
7.2 Subscription Terms
Section titled “7.2 Subscription Terms”Subscription plans, pricing, and billing cycles are as specified in the monday.com Marketplace listing. Subscriptions may auto-renew unless cancelled in accordance with monday.com’s policies.
7.3 Refunds
Section titled “7.3 Refunds”Refund requests are subject to monday.com’s refund policies as the payment processor.
8. Intellectual Property
Section titled “8. Intellectual Property”8.1 Ownership
Section titled “8.1 Ownership”The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, and design) are owned by Flowboard or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Your Content
Section titled “8.2 Your Content”You retain ownership of all content you create within the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
8.3 Feedback
Section titled “8.3 Feedback”Any feedback, suggestions, or ideas you provide about the App may be used by us without any obligation to you.
9. Disclaimer of Warranties
Section titled “9. Disclaimer of Warranties”THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- The results obtained from the App will be accurate or reliable
- The quality of the App will meet your expectations
- Any errors in the App will be corrected
10. Limitation of Liability
Section titled “10. Limitation of Liability”TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLOWBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of (or inability to access or use) the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use, or alteration of your content or data
Our total liability for any claims arising from or relating to these Terms or the App shall not exceed the amount you paid to us for the App in the six (6) months preceding the claim.
11. Indemnification
Section titled “11. Indemnification”You agree to indemnify, defend, and hold harmless Flowboard and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you create or share through the App
12. Termination
Section titled “12. Termination”12.1 Termination by You
Section titled “12.1 Termination by You”You may stop using the App at any time by uninstalling it from your monday.com account.
12.2 Termination by Us
Section titled “12.2 Termination by Us”We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice.
12.3 Effect of Termination
Section titled “12.3 Effect of Termination”Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
13. Changes to Terms
Section titled “13. Changes to Terms”We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website or through the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
14. Governing Law
Section titled “14. Governing Law”These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
Section titled “15. Severability”If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
Section titled “16. Entire Agreement”These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flowboard regarding the App and supersede all prior agreements and understandings.
